Job Description: Environmental Research Center, Inc. (ERC) is a mission-driven nonprofit dedicated to reducing or eliminating contamination in consumer products. We are seeking a skilled and passionate In-House Counsel to join our legal team and serve as a key legal advisor for the organization's litigation matters. Serve as a trusted legal advisor on a broad range of matters affecting the organization's mission and operations. Manage and supervise ERC's outside counsel engaged in pre- and post-litigation activities, including overseeing case strategy, communicating with outside counsel and opposing counsel or corporate contacts, communicating with in-house legal team and Executive Director, participating in settlement negotiations, and maintaining proper case status and flow. Handle cases in litigation from intake through resolution, coordinating with internal stakeholders and external counsel. Review and oversee Notices of Violation under California Proposition 65, analyzing pertinent issues and recommending a course of action. Draft, review, and negotiate a wide variety of legal documents, including correspondence, pleadings and motions including but not limited to Complaints, Discovery Requests and Responses, Deposition Notices, Subpoenas, Sanction Motions, Demurrers, Motions To Compel, Case Management Statements, Settlement Agreements, and Consent Judgments. Research and respond to opposition motions, including but not limited to Motions to Quash, Summary Judgments, and Discovery Motions. Conduct legal research and provide written and oral opinions on relevant legal issues involving or impacting Proposition 65 and related litigation. Supervise and mentor paralegals and other legal support staff, providing guidance on workflow and professional development. Maintain a case load of your own that includes a bonus program Stay current on relevant laws and Proposition 65 regulations and proactively advise leadership on legal risks and opportunities. REQUIRED QUALIFICATIONS Juris Doctor (J.D.) from an accredited law school Active California bar membership in good standing Minimum 10 years of legal practice experience Litigation background, in-house or firm Strong legal research and writing skills Experience supervising staff or paralegals Outside counsel management experience PREFERRED QUALIFICATIONS Experience with California Proposition 65 notices and compliance Prior in-house experience, especially within a nonprofit organization Experience in legal areas of environmental law, statutory/regulatory compliance, or consumer rights WHAT WE OFFER Competitive nonprofit salary and bonus program CLE reimbursement and bar dues coverage Meaningful, mission-driven work Collaborative, inclusive organizational culture Benefits:Paid time off Work Location: Remote. A hired candidate may be able to work remote from their current location continent upon being readily accessible during and after normal business hours. We are in Georgia on Eastern time but operate under California law on Pacific time so there a 3 hour difference where he/she may need to be available. Candidate would need to be available to travel for mediations, depositions, etc which is normal for this type of work.
